Welcome to Pegaso Travel LLC (“Pegaso Travel,” “we,” “our”). These Terms and Conditions (“Terms”) govern the access and use of our services and website. By using our services, you (“User” or “Client”) signify your acceptance of these Terms.

1. Nature of the Service

Pegaso Travel acts as an intermediary between the Client and tourism service providers, especially airlines and flight operators. Pegaso Travel is not an air carrier, hotel, or direct operator of any service.

The final contract for transportation, accommodation, or service is entered into directly between the Client and the provider (e.g., airline), with the provider being solely responsible for the provision of the purchased service.

2. Bookings and Ticket Issuance

• Airfares, taxes, fees, and charges are determined by the airlines and may vary until the moment the ticket is issued.

• Some promotional fares are strictly non-refundable and do not allow changes.

• Once the ticket is issued, all modifications are subject to availability and the airline's fare rules.

• It is the Client's responsibility to review the specific fare conditions before confirming their purchase

3. Documentation and Immigration Requirements

• It is the sole responsibility of the Client** to possess valid and current documentation, such as a passport, visas, health permits, or any immigration requirements demanded by the authorities of the destination or transit country.

• Pegaso Travel assumes no responsibility for denied boarding, entry, or immigration issues.**

4. Cambios y Cancelaciones

4.1. Changes

• All changes to flight dates, times, names, or routes are subject to the operating airline's policies and may incur penalties, fare differences, or additional charges.

• Some fares do not allow changes at all.

4.2. Cancellations

• Cancellation requests must be managed through Pegaso Travel, who will act as a liaison with the airline or operator.

• The possibility of cancellation and the amount to be refunded (if applicable)** will depend exclusively on the airline's policies.

• Pegaso Travel does not guarantee the refund of any amount paid.

5. Refund Policy

5.1. Air Service Providers

• Airlines are the ones that determine whether an air ticket is refundable or not, and under what conditions.

• Pegaso Travel cannot modify, disregard, or alter the refund policies imposed by the airline.

• For non-refundable fares , the Client accepts that they will not be entitled to recover the amount paid, unless the airline, due to operational reasons or force majeure, authorizes exceptions.

5.2. Procedure

• The Client must request Pegaso Travel to process their refund.

• Pegaso Travel will process the request with the airline, but **cannot guarantee timelines or outcomes**, as these depend solely on the airline.

• If approved, the refund will be processed using the same payment method as the original purchase, unless the airline specifies otherwise.

5.3. Deductions and Expenses

• Airlines may deduct penalties, administrative fees, or operational expenses from the refundable amount.

• Any management service fees charged by Pegaso Travel (if applicable) are non-refundable.

• Government **fees or taxes might not be refundable** depending on the country's or airline's regulations.

5.4. Force Majeure Cases

• In cases such as mass cancellations due to health emergencies, border closures, airline bankruptcies, or other extraordinary circumstances, refunds or solutions will be exclusively those determined by the airline or operator (e.g., rescheduling, bonuses, vouchers).

• Pegaso Travel assumes no obligation for reimbursement if the provider does not authorize the refund.

6. Responsibility

• Pegaso Travel acts as an intermediary and is not responsible for the provision, modifications, delays, cancellations, insolvencies, accidents, losses, or damages caused by airlines, hotels, operators, or any other tourism service provider.**

• Pegaso Travel is not responsible for additional expenses incurred due to operational changes, overbooking, itinerary changes, or other events attributable to airlines.

• The Client acknowledges that the contracted service depends on the provider and that Pegaso Travel has no influence over flight operations or the determination of their policies.

7. Claims

• Any claims related to tourism services must be submitted in writing to Pegaso Travel within a maximum of **15 calendar days from the date of the service.**

• Pegaso Travel will act as an intermediary, but decisions regarding compensation, refunds, or indemnities rest exclusively with the airlines or providers.**

8. Intellectual Property

All content on our website (texts, images, logos, software, design) is the property of Pegaso Travel LLC or its licensors. Unauthorized use is prohibited.

9. Modifications

Pegaso Travel may modify these Terms at any time. Changes will be effective upon their publication on the website.

10. Ley Aplicable y Jurisdicción

These Terms will be governed by the laws of the State of Florida, United States. Any dispute will be resolved before the competent courts of that State.
